Terms and conditions Finca de los Secretos

1. Definitions

For the purpose of these Terms and Conditions, the following definitions shall apply:

  • Lessor: Character Living Real Estate S.L.

  • Property: Finca de los Secretos, Tourist Rental Licence No. VT-509466-A.

  • Lead Guest: The person making the reservation and entering into the rental agreement.

  • Guests: All persons staying at the Property during the rental period.

  • Property Manager: The representative appointed by the Lessor to manage and maintain the Property.

  • Booking: A confirmed reservation of the Property.

  • Rental Period: The agreed period during which the Property is occupied by the Guests.

  • Security Deposit: The refundable deposit paid as security against damage, loss, or additional costs.

2. Reservations and Payments

2.1 A reservation becomes confirmed upon receipt of a deposit equal to 30% of the total rental amount.

2.2 The deposit must be received within three (3) days of the reservation request.

2.3 The remaining balance of 70% of the rental amount must be paid no later than six (6) weeks before the arrival date.

2.4 The refundable Security Deposit of EUR 1.000 must be paid no later than seven (7) days before the arrival date.

2.5 If payment is not received by the due date, the Lessor reserves the right to cancel the reservation without refund of any amounts already paid.

3. Cancellation Policy

3.1 If the Booking is cancelled more than six (6) weeks before arrival, the 30% deposit is non-refundable.

3.2 If the Booking is cancelled within six (6) weeks before arrival, the full rental amount remains payable and no refund will be issued.

3.3 All cancellations must be submitted in writing by email. The date of receipt will determine the applicable cancellation terms.

3.4 Guests are strongly advised to obtain comprehensive travel and cancellation insurance.

4. Rental Conditions

4.1 The Property may accommodate a maximum of eight (8) persons, including children.

4.2 Only the persons stated on the Booking may occupy the Property.

4.3 The Property may only be used for holiday purposes.

4.4 Events, parties, weddings, commercial activities, photo shoots, and gatherings are not permitted without prior written approval from the Lessor.

4.5 Subletting is strictly prohibited.

5. Included Services

The rental price includes:

  • Water consumption

  • Wi-Fi internet

  • Cooking gas

  • Standard electricity consumption up to 225 kWh per week

Electricity consumption exceeding 225 kWh per week will be charged at a rate of EUR 0.50 per kWh. Any additional electricity costs will be deducted from the Security Deposit or invoiced separately after departure.

6. Security Deposit

6.1 A refundable Security Deposit of EUR 1,000 is required.

6.2 The Security Deposit must be paid no later than seven (7) days before arrival.

6.3 The Security Deposit will be refunded within seven (7) days after departure, provided that:

  • No damage has occurred;

  • No items are missing;

  • No excessive cleaning is required;

  • No breaches of these Terms and Conditions have occurred.

6.4 The Lessor reserves the right to deduct reasonable costs from the Security Deposit for damages, losses, repairs, additional cleaning, excess electricity consumption, or other costs arising during the stay.

7. Guest Responsibilities

7.1 Guests shall treat the Property, its furnishings, equipment, and grounds with due care.

7.2 Any damage, defect, or malfunction discovered during the stay must be reported immediately to the Property Manager.

7.3 Guests are responsible for all damage caused by themselves, their visitors, or members of their party.

7.4 Guests shall respect neighbouring properties and avoid causing nuisance, disturbance, excessive noise, or inconvenience.

8. Property Rules

8.1 Pets are not permitted.

8.2 Smoking inside the Property is strictly prohibited.

8.3 Guests are requested to switch off lights and air-conditioning units when rooms are unoccupied.

8.4 Doors, windows, and gates must be secured whenever the Property is left unattended.

8.5 Any alarm system provided must be activated when leaving the Property.

8.6 Glassware is not permitted in or around the swimming pool area.

8.7 Air-conditioning units should only be operated with doors and windows closed.

8.8 Open fires are prohibited. Barbecues may only be used responsibly and entirely at the Guests’ own risk.

9. Swimming Pool and Safety

9.1 The swimming pool is used entirely at the Guests’ own risk.

9.2 Children must be supervised by a responsible adult at all times.

9.3 Due to the swimming pool, terraces, stairs, and level differences throughout the Property, Guests are responsible for ensuring the safety of all members of their party.

10. Check-in and Check-out

10.1 Check-in is available from 4:00 PM and check-out must take place no later than 10:00 AM, unless otherwise agreed in writing.

10.2 Upon departure, Guests shall leave the Property in a clean and tidy condition.

10.3 Excessive cleaning requirements may result in additional charges.

11. Liability

11.1 Guests occupy and use the Property entirely at their own risk.

11.2 The Lessor and Property Owner shall not be liable for:

  • Personal injury;

  • Loss of life;

  • Theft;

  • Loss of or damage to personal belongings;

  • Accidents occurring on the Property;

  • Interruptions of utilities, internet services, or technical installations;

  • Construction works, roadworks, or disturbances beyond the Lessor’s control.

11.3 The Lessor’s liability, where legally established, shall be limited to direct damages and shall never exceed the total rental amount paid by the Lead Guest.

12. Force Majeure

12.1 The Lessor shall not be liable for failure to perform its obligations due to circumstances beyond its reasonable control, including but not limited to:

  • Natural disasters;

  • Floods;

  • Fire;

  • Pandemics;

  • Government actions;

  • Utility failures;

  • Civil unrest;

  • Strikes.

12.2 In such circumstances, the Lessor may offer alternative accommodation, reschedule the Booking, or provide a partial refund for unused rental days where appropriate.

13. Privacy

The Lessor shall process personal data in accordance with applicable European and Spanish data protection legislation, including the General Data Protection Regulation (GDPR).

14. Tourist Registration

14.1 In accordance with Spanish law, all Guests must provide valid identification before or upon arrival.

14.2 Guest information may be registered with the relevant Spanish authorities where legally required.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions shall be governed by and interpreted in accordance with Spanish law.

15.2 Any dispute arising out of or relating to these Terms and Conditions shall be submitted exclusively to the competent courts of Alicante, Spain.

16. Final Provisions

16.1 By making a Booking, the Lead Guest confirms acceptance of these Terms and Conditions on behalf of all Guests included in the reservation.

16.2 If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
