Terms and conditions Hidden Villa Javea

In these terms and conditions the following concepts and their definitions should be understood as follows:

1. the lessor: Character Living Real Estate SL
2. the holiday home: Hidden Villa Javea rental no. VT-437315-A
3. the lessee/tenant: the person who rents the holiday home as specified under 2 or any person who wishes to do so;
4. the co-tenant(s): the person(s) who stays with the lessee in the premises as specified under point 2;
5. the administrator: the person who on behalf of the lessor performs the task of maintenance and administration of the holiday home;
6. the offer: the offer/proposal as meant in the New Civil Code. (Dutch law);
7. cancellation: the revocation or dissolution of a booking within the term that has been established for this purpose;
8. booking: a confirmed reservation for the holiday home;
9. dissolution: the annulment according to legal procedure of the rental agreement on account of not complying with the terms and conditions of the rental agreement;
10. sojourn/stay: the actual use of the holiday home.

Reservation and booking

1. Within 3 days after the reservation the lessee must have transferred thirty percent (30%) of the total rent to the bank account of the lessor. This will serve to confirm the booking, making it peremptory.

Renter Cancellation

1a. A 70% cancellation policy is applicable when cancellations are made within 6 weeks before the date of arrival.

1b. In case of later cancellations the lessee is indebted for the full amount of the total rental sum. In either case the date of receipt of the cancellation will be binding. Cancellations must be done by means of a registered letter.

1c. We advise to obtain travel insurance for protection against, among other things, your inability to make the trip contemplated by this agreement.

Covid-19 Exceptional Cancellation Policy

2. An addition to the regular cancellation policy is being made and applies to the future developments of the current global Covid-19 pandemic. Defined as an unforeseen circumstance and beyond everyone’s control. 

2a. The COVID-19 cancellation policy applies when:

– A reservation must be canceled due to Government-imposed travel restrictions,. 

– Because an entry- or exit ban is in force for certain countries at the time of traveling, government-imposed by the country of destination and / or country of origin – issued strict negative travel advices, or issued code red. 

2b. The tenant can cancel the reservation and the rental sum + the damage deposit sum will be refunded             

2c.  To be eligible for the “Covid-19 Exceptional Cancellation Policy”, the tenant  may be required to provide the agency with proof of inability to travel during the rental period.

2d.  For all other cancellations unrelated to COVID-19, the standard cancellation policy of this agreement will apply.

2e. We recommend to take out travel insurance to have cover for inability to travel due to sickness or for illness during travel away from home. If a guest becomes ill before they stay with Hidden Villa we refer them to their travel insurance provider. 

If a guest becomes ill or suspects they have contracted the Covid-19 virus whilst staying in our villas, our local representative is available for additional support. Upon first notification, we will contact the local health authority for instructions and work with them to deliver assistance where needed. 

If guests need to stay within the home they would need to pay for the additional nights. Staying in the house is only possible when it is available in this period.


3. The rent is calculated for the period of stay. It is not allowed to use the accommodation with more than 10 persons, including children over the age of two. Exact representation of group specification (age structure / maximum group size) prior to booking is confirmed to lessor by tenant.

3a. The rent includes the expenses for current, cooking gas, water, WIFI, and 225 kWH electricity a week.

Payment of the rent

4. 6 weeks prior to arrival of the agreed rental period the balance of the amount, which is the 70% percent must be credited on Lessors account. In case the money has not been received by the lessor, the lessee will not be checked in and the lessor will dissolve the agreement out of court. The lessee is not entitled to restitution of the down payments. This will serve as compensation for damages suffered by the lessor through non-compliance of the lessee.

Guarantee deposit

5. 6 weeks upon arrival, a deposit of EUR 1000,- has to be paid on the bank account of Hidden Villa as a security deposit for damages. Refund within 7 days after check-out.

Obligations for the lessee/ Rules of the house

6. The lessee commits himself to managing the rented object and its appurtenances as a prudent man. All damage to the rented object that the lessee notices during his rental period will have to be reported to the lessor by him and the lessee is accountable for damages that have been incurred by himself or because of him.

7. The lessee commits himself not to cause any inconvenience.

8. Except of prior obtained permission the rented object may only exclusively be used for holiday purposes. This exception also goes for celebrations and parties.

9. Sub-letting is not allowed.

10. It is not allowed to carry out alterations or modifications to the house itself, the swimming pool and the garden.

11. In connection with vermin all food leftovers in and around the house will have to be cleared away immediately.

12. Pet-animals are not allowed.

13. We kindly ask to please switch off the all lights and airco’s in the daytime when the house is unoccupied.

14. Doors should be locked at all times – where the key locks should be used – when the tenant leaves the house and/or the house is unoccupied.

15. The alarm system (if provided) must be switched on at all times when the tenant leaves the house. The villa representative will give full instructions of the system and code.

16. In the direct vicinity of, or at the swimming pool, all glass kitchenware is forbidden. This is in connection with the imminent danger of its usage.

17. The use of air conditioning units is exclusively limited to the circumstance when all doors and windows are closed. During the daytime and when the sleeping quarters are not in use we kindly ask you to please switch off all air-conditioning units.

18. Open fires are NOT allowed by law. When using the BBQ/grill, all on the lessee’s risk and full responsibility.

19. Because of the unfenced swimming pool / and any some height differences in and around the property, strict supervision of children of all ages is strictly advised and deemed necessary at all times.

Completion/ delivery

20. At the end of the term the lessee commits himself to deliver the rented object and its appurtenances in a swept clean status. Should the lessee fail to do so in this respect or in other respects fail to meet the obligations stemming from this agreement the lessor is entitled to settle all resulting damages with the deposited guarantee sum, without prejudice to the right of the lessor to further damages. 


21. The lessor and property owner are not liable for damages suffered by or to the lessee or by third parties present on account of the lessee as a result of their stay in the rented property. The lessee and third parties indemnifies lessor against claims in this respect. In particular the lessor and property owner are not responsible for damages resulting from burglary and also not for damages because of burglary suffered by third parties present on account of the lessee. The lessor is not liable for disturbances and interruptions such as, but not exclusively, interruptions of utility services (electricity and water) and technical installations, and for construction activities and alterations to the main roads and access roads without prior and timely notification.

22. The lessor can only be held liable for damages attributed to gross fault or negligence from the lessor’s part. This liability is always limited to direct damages and all collateral damages are excluded. It is advised to take out personal travel insurance.

Circumstances beyond control

23. In case of circumstances beyond control, be it of a permanent and or of a temporary nature, the lessor has the right to dissolve the agreement completely or partially, or to suspend it temporarily. Under this circumstance the lessee will be offered an alternative accommodation, or will receive refund of the rental costs, in full or partially of the un spend days. 


24. The lessor shall treat all personal data submitted or known to him in conformity with the Law on Protection of Personal Data. 

Applicable Jurisdiction

25. As far as not stipulated otherwise by the rules of Private International Law, Dutch law exclusively applies to the present agreement. All disputes pursuant from this rental agreement will in first instance be tried by the competent judge in The Netherlands, unless the rules of the Private International Law stipulate otherwise.
